PROBATE is the process by which a decedent’s assets are distributed upon death in accordance with a person’s will or by statute in the event that there is no valid will. The manner in which the assets are titled may determine whether probate is required.

For example, an asset titled in the sole name of the decedent at the time of the decedent’s death normally requires probate. However, assets that are held in a trust, jointly with another or where a beneficiary is designated on an account normally do not require probate.

GUARDIANSHIP is the process by which a person or entity is appointed by the court to administer the personal and/or financial affairs of a person who is legally adjudicated to be partially or totally incapacitated.

There are various forms of guardianship including involuntary guardianship, voluntary guardianship, or guardianship of a minor. Guardianship should be pursued as a last resort and the need for a guardianship can be avoided with the proper planning such as powers of attorney, designations of health care surrogate, and a revocable trust.
